1. Who These Terms Apply To

These Terms and Conditions govern your use of presencify.digital and any services provided by Presencify, a digital presence agency based in Islamabad, Pakistan. By visiting our website, contacting us, or purchasing any of our services, you agree to these terms in full.

If you do not agree with any part of these terms, please do not use our website or services.

2. Our Services

Presencify provides digital services including but not limited to:

• Portfolio and business website design and development
• Ecommerce and Shopify store development
• Dropshipping store setup
• WordPress development
• Web application development
• AI chatbots and intelligent agents
• Data science and machine learning solutions
• Data pipelines and engineering
• Data analytics and visualization
• Computer vision and deep learning
• Social media marketing and branding
• Product photography (Rawalpindi and Islamabad only)

The scope, timeline, and deliverables of each project are defined in a separate project agreement or proposal shared with you before work begins. These Terms and Conditions apply alongside that agreement.

3. Project Agreements and Scope

Before any project begins, Presencify will provide a written scope of work outlining what is included, the timeline, the price, and the payment schedule. Work will not begin until the scope is agreed upon and the initial payment is received.

Any changes to the agreed scope during a project — including additional pages, features, revisions beyond the agreed number, or changes in direction — will be treated as a scope change and may result in additional charges and timeline adjustments. We will always notify you before proceeding with out-of-scope work.

4. Payments

Payment schedule:

Unless otherwise agreed in writing, our standard payment structure is:

• 50% deposit required before work begins
• 50% due upon project completion before final files or access are handed over

Late payments:

If payment is not received within 7 days of the due date, Presencify reserves the right to pause work on the project until payment is received. If payment is not received within 30 days, Presencify may terminate the project and retain the deposit to cover work completed.

Refunds:

Deposits are non-refundable once work has begun. If a project is cancelled before work begins, a full refund of the deposit will be issued within 7 business days.

Currency:

All prices are quoted and invoiced in Pakistani Rupees (PKR) unless otherwise stated in writing.

5. Revisions

Each project includes a specified number of revision rounds as outlined in the project agreement. Revisions are defined as reasonable adjustments to the agreed design or functionality — not redesigns or additions of new features.

Revisions beyond the agreed number will be billed at our standard hourly rate, which will be communicated to you in advance.

6. Timelines and Delivery

Presencify will provide an estimated delivery timeline at the start of each project. These timelines are estimates and are dependent on timely feedback, content, and approvals from the client.

Presencify is not responsible for delays caused by:

• Late provision of content, images, or materials by the client
• Delayed approvals or feedback from the client
• Third-party platform outages or delays (hosting providers, domain registrars, payment gateways, etc.)

If Presencify anticipates a delay on our end, we will notify you as soon as possible.

7. Client Responsibilities

To ensure your project is delivered on time and to the highest standard, you agree to:

• Provide all required content, images, logos, and materials within the agreed timeframe
• Respond to questions, proofs, and approval requests within 5 business days
• Provide accurate and complete information about your business and requirements
• Ensure you have the legal right to use any content, images, or materials you provide to us

Presencify is not liable for any legal issues arising from client-provided content including copyright infringement, defamation, or misrepresentation.

8. Intellectual Property

Your content:

Any content, logos, images, or materials you provide remain your property. You grant Presencify a non-exclusive license to use them solely for the purpose of delivering your project.

Our work:

Upon receipt of full and final payment, ownership of the completed project deliverables transfers to you. Until full payment is received, all work remains the intellectual property of Presencify.

Portfolio rights:

Presencify reserves the right to display completed projects in our portfolio and use them for promotional purposes including on our website, social media, and in marketing materials, unless you request otherwise in writing before the project begins.

Our tools and systems:

Any proprietary frameworks, templates, systems, or methodologies developed by Presencify and used in your project remain the intellectual property of Presencify. You receive a license to use the final delivered product — not the underlying systems.

Digital Authority Score™:

The Digital Authority Score™ is a proprietary framework developed by Presencify. It may not be reproduced, rebranded, or used commercially without written permission from Presencify.

9. Confidentiality

Both parties agree to keep confidential any sensitive business information shared during the course of a project. Presencify will not share your business details, project specifications, or proprietary information with third parties without your consent, except where required by law.

10. Hosting, Domains, and Third-Party Services

Where Presencify purchases a domain or sets up hosting on your behalf as part of a service package, the following applies:

• The domain is purchased in your name and transferred to your control upon full payment
• After the first year (where included in your package), renewal costs are your responsibility
• Presencify is not responsible for third-party platform downtime, outages, or policy changes including Vercel, Shopify, WordPress, or any domain registrar
• If you choose to move your website to a different host or provider after delivery, Presencify is not responsible for any compatibility issues that arise

11. Warranties and Limitations

Presencify delivers all work to the best of our ability and with professional care. However:

• We do not guarantee specific business outcomes such as increased sales, follower growth, or search engine rankings as a result of our work
• We do not guarantee that websites will be free from all bugs or errors after delivery, though we will fix any bugs reported within 14 days of launch at no additional charge
• SEO results depend on many factors outside our control including search engine algorithms, competition, and content quality

To the maximum extent permitted by law, Presencify’s total liability for any claim arising from our services is limited to the amount you paid us for the specific project in question.

12. Termination

Either party may terminate a project with 7 days written notice. In the event of termination:

• You will be invoiced for all work completed up to the termination date
• Any deposit paid will be applied against this invoice
• Final deliverables will only be released upon settlement of all outstanding amounts
• If Presencify terminates the project due to non-payment or breach of these terms, the deposit is forfeited

13. Governing Law

These Terms and Conditions are governed by the laws of Pakistan. Any disputes arising from these terms or our services will be subject to the jurisdiction of the courts of Islamabad, Federal Capital, Pakistan.

14. Changes to These Terms

Presencify reserves the right to update these Terms and Conditions at any time. Changes will be posted on this page with an updated date. Your continued use of our services after any changes constitutes your acceptance of the revised terms.
